IMPORTANT: PLEASE READ THE FOLLOWING BEFORE YOU SUBMIT YOUR REGISTRATION FOR THE PRECAST SHOW
IN CONSIDERATION OF THE OPPORTUNITY TO ATTEND THE PRECAST SHOW (“Event”), AND BY SUBMITTING YOUR REGISTRATION, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREED TO THE FOLLOWING TERMS AND CONDITIONS (“Terms & Conditions”)
CANCELLATION/SUBSTITUTIONS and CHANGE OF VENUE
Cancellations must be received by February 8, 2023. All refund requests must be submitted to refunds@precast.org. An administrative fee of $50 per registrant will be deducted from all refunds. Due to financial obligations, no refunds will be issued after February 8, 2023. If NPCA, in its sole discretion, determines that it is unable to offer an in-person Event, NPCA reserves the right to offer the Event virtually.
CODE OF CONDUCT
NPCA is committed to providing a safe, productive, and welcoming environment for all meeting participants and staff. All participants, including, but not limited to, attendees, speakers, volunteers, sponsors, staff members, service providers, and all others are expected to abide by the NPCA Code of Conduct.
SOLICITATIONS
It is prohibited to solicit, display, promote or advertise any service or product other than as permitted as an official exhibitor. This prohibition applies throughout the convention center and everywhere within a quarter-mile radius of the convention center.
PHOTO AND VIDEO RELEASE
You grant permission to NPCA to (i) record your image, likeness, and/or voice on a photographic, video, audio, digital, electronic, or any other medium, (ii) use, reproduce, modify, exhibit and/or distribute any such recording, in whole or in part, in any manner or medium now known or hereafter developed (including without limitation, print publications, DVDs and internet) for any purpose that NPCA may deem appropriate, including without limitation promotional or advertising efforts; and (iii) use your name and biographical material in connection with any such recordings or uses. You understand and agree that your image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein your likeness appears. You understand that NPCA will be the owner of all such recordings and uses. Additionally, you waive any right to royalties or compensation arising from or related to the use of your image or recording. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.
NO RECORDING
You agree that you will not use any audio or video recording technology (including devices with digital camera functionality, such as smartphones or tablets, and recording software, such as screen capture or similar software) during any presentation and will not record or photograph any speakers or any presentation at the Event, unless expressly permitted by NPCA. You will not make any part of the materials presented at the Event public or issue any press releases related to the Event without express prior written approval from NPCA.
PERSONAL INFORMATION
You understand that you are providing your personal information to NPCA in order to register you for the Event and so you may participate in the Event. You understand that some of your personal information may be provided to third parties, including but not limited to Event sponsors, Event exhibitors and other Event attendees. Your personal information may be shared with other third parties who will be providing services directly related to the event, including but not limited to the registration vendor, the conference app provider, a silent auction platform, and The Precast Show DMC. You further understand that some of your personal information may be used by sponsors for promotional, marketing, and sales related information. CREDIT CARD INFORMATION
If you provide your credit card information, you understand and acknowledge that your credit card information, if applicable, will be used by NPCA to process the fee(s) described during the payment process. In addition, if you attend any related events that you have not registered or paid for, NPCA reserves the right to charge your credit card for the amount of the registration fee for that specific event.
DISCLAIMER AND LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER NPCA NOR ANY OF ITS DIRECTORS, EMPLOYEES OR OTHER REPRESENTATIVES WILL BE LIABLE FOR ANY OF THE FOLLOWING LOSSES OR DAMAGE (HOWSOEVER ARISING AND WHETHER SUCH LOSSES WERE FORESEEABLE OR NOT): LOSS OF PROFIT, LOSS OF REVENUE, LOSS OF BUSINESS OR OPPORTUNITY, LOSS OF REPUTATION OR GOODWILL, AND/OR ANY INDIRECT, CONSEQUENTIAL OR SPECIAL LOSS; WHETHER ARISING IN CONNECTION WITH THE EVENT OR THE PROVISION OF OUR SERVICES TO YOU.
INDEMNIFICATION AND RELEASE
You agree to indemnify, defend, and hold harmless NPCA and its officers, directors, employees, agents, hotel suppliers, vendors, agencies, guests, and attendees (“Released Parties” )from and against any and all demands, claims, fines, investigations, penalties, damages, losses, liabilities, judgments, and expenses (including reasonable attorneys’ fees and court costs) (collectively, “Claims”) relating to your failure to comply with these Terms and Conditions and your participation in the Event including but not limited to any Claims arising in any manner out of your contracting COVID-19 or any similar illness, damages on account of injury, death, or damage to property incurred in connection with any action brought in any way connected with the Event, except when caused by the negligence of Released Parties. This agreement is specifically intended to operate as a waiver of liability to the fullest extent allowed by law Further, for yourself and your heirs, personal representatives and assigns, you hereby release, relinquish and discharge NPCA and its predecessors, successors, assigns, legal representatives, and its former, present and future agents, officers, directors and employees from any liability resulting from the negligence of NPCA or any of the Released Parties.
COVID-19 REPRESENTATIONS
You represent and warrant that you will not enter the venue or participate in the Event in person if (a) you are aware, as of the date of the Event, that you have contracted and not completely recovered from COVID-19 or another communicable disease; (b) you are aware, as of the date of the Event, that you have been exposed within the prior two weeks to someone who had contracted or was subsequently determined to have contracted, COVID-19 or another communicable disease; (c) you have been tested for COVID-19 or another communicable disease but not yet received the results of such test; or (d) you have symptoms consistent with having contracted COVID-19 or another communicable disease. You also represent and warrant that, during the course of the Event, you will comply with all applicable regulations and guidelines regarding COVID-19 and any other communicable disease, including those imposed by the venue, federal, state and local government and/or NPCA.
You represent that should you fail any screening or do not comply with COVID-19 safety protocols that you will leave the Event venue and you agree that you will not be due a refund of your Event ticket.
MINORS
A parent/guardian must accompany minors under the age of 18 in the meeting space.
GENERAL
NPCA reserves the right to change, amend, add, or remove any of these Terms & Conditions in its sole discretion and without prior notice. If one or more of the conditions outlined in these Terms & Conditions should become invalid, the remaining conditions will continue to be valid and apply. These Terms & Conditions apply to all event participants (attendees, guests, speakers, sponsors, exhibitors).
NPCA reserves the right, due to unforeseen circumstances, to alter the content, location, timetable, speakers, venue, and/or other technical or administrative details in respect to the Event. NPCA will endeavor to provide you with notice of any such alterations.
The views expressed by any event attendee, guest, speaker, exhibitor, or sponsor are not necessarily those of NPCA. All attendees, guests, speakers, exhibitors, and sponsors are solely responsible for the content of all individual or corporate presentations, marketing collateral, and/or advertising.
These Terms & Conditions and any dispute or claim arising out of, or in connection with them or their subject matter, shall be subject to laws of Indiana, exclusive of the choice of law rule or any jurisdiction.
