NPCA this week cosigned a letter to Congress to express concerns about the greenhouse gas performance measure regulation finalized Nov. 23 by the Federal Highway Administration (FHWA).

The letter – signed by 14 other associations – argues that regulatory overreach outside the bounds of the Infrastructure Investment and Jobs Act (IIJA) has the potential to limit the impact of rebuilding America’s transportation systems. It further states the FHWA lacks the statutory authority to create a greenhouse gas performance measure and supports congressional efforts to block the rule’s implementation.

The rule currently is facing a lawsuit brought by 21 states.
