Precast.org and all related pages and subdomains are operated by National Precast Concrete Association (“NPCA” or “we” or “association”). NPCA is committed to protecting your privacy. This privacy policy covers the storage and use of any personal information or data that can personally identify you that you choose to share with us via precast.org, as well as your choices regarding our use of such information.
In some cases, precast.org links to other sites outside of this domain. In those instances, this privacy policy is no longer applicable, and we encourage you to review the privacy policy of that site.
Data and Information Collection
Precast.org tracks information including IP address and browser type and uses cookies, small files placed on your computer, to store information about users to enhance your experience and for the purpose of remarketing. All users can disallow the use of cookies via precast.org, as well as set their browsers to warn about the use of cookies or to turn them off. However, some features of precast.org may be unavailable when cookies are disabled.
On certain pages of precast.org, forms ask for personal information such as name, address, telephone number, employer and email address to provide certain services. All information is securely stored by NPCA or NPCA vendors and never shared with individuals outside of the organization without permission. At all points of email collection, a box must be checked by the user to allow NPCA to use that email address in the future. All emails sent by NPCA other than those sent by an individual staff member provide the option to unsubscribe from the list.
NPCA does not knowingly collect personal information from minors and/or market to minors. Any information identified as linked to a minor will be deleted.

Data and Information Usage
NPCA uses information collected or shared to provide and improve services. NPCA will never share, sell or distribute your information with other individuals, including other association members, without your direct consent or in the following circumstances:
Vendors: We use third-party vendors to create and maintain our site. Those vendors may have access to information shared or collected via precast.org but may not use it for any purpose other than precast.org due to confidentiality agreements in place.
Legal: In the event of a valid court order, subpoena, government investigation, or as otherwise required by law, NPCA will share information to remain in compliance with the law. NPCA will also report any activities we believe to be unlawful or related to an alleged unlawful activity. NPCA also acts as needed to protect the rights, property, or safety of the association, our members, affiliated companies, our users and others.
Sale or Acquisition: If we become involved in a transaction involving the sale of our assets, such as a merger or acquisition, we may disclose and/or transfer your information as part of the transaction. Your information may be used pursuant to the that entity’s privacy policies.
With Your Consent: Other than as set out above, your information will not be shared with outside parties unless consent is given.
Security
We take reasonable precautions to protect your information, including but not limited to, authentication, monitoring, auditing, and encryption. Unfortunately, no data transmitted over or accessible through the Internet can be guaranteed to be completely secure. As a result, we cannot ensure or warrant that your information will be secure from misappropriation by hackers, nefarious or criminal activities, or in the event of a failure of computer hardware, software, or a telecommunications network. We do not accept any liability for the security of the information or data submitted to us nor for your or third parties’ use or misuse of personal data.
NPCA’s liability for misuse or misappropriation of information shall be limited to direct damages caused by NPCA’s gross negligence or intentional misconduct, and shall be limited to the coverage of NPCA’s insurance. NPCA shall have no liability for indirect, incidental, consequential, exemplary, or punitive damages.
All claims, disputes, controversies, and other matters in question arising in connection with this Privacy Policy shall be submitted to mediation conducted pursuant to the Mediation Procedures of the American Arbitration Association. All claims, disputes, controversies, and other matters in question not resolved by mediation shall be concluded by arbitration conducted by a single arbitrator pursuant to the Commercial Arbitration Rules of the American Arbitration Association. Mediation and arbitration shall take place in Indianapolis, Indiana. The award rendered by the arbitrator shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. This agreement to mediate and to arbitrate shall be specifically enforceable under applicable law in any court having jurisdiction thereof. The parties to this agreement submit themselves to the personal jurisdiction of the courts of Indiana for that purpose.
